Heavy Trader Hub – Terms of Use

Welcome to Heavy Trader Hub (“Platform,” “we,” “us,” or “our”). Heavy Trader Hub is an online marketplace that allows users to list, browse, and inquire about heavy equipment, machinery, parts, and related services.

By accessing or using the Platform, including registering an account, you agree to these Terms of Use. If you do not agree, you may not use the Platform.

1. Eligibility

You must be at least 18 years of age.
You must be legally able to enter into binding contracts under U.S. law.
Businesses must be legally authorized to operate within the United States.

2. Account Registration

You agree to provide accurate, current, and complete information.
You may maintain one account unless otherwise authorized.
Accounts may not be transferred, sold, or shared.
You are responsible for all activity conducted through your account.

3. Account Security

You are responsible for safeguarding your login credentials.
Notify Heavy Trader Hub immediately of any unauthorized account use.
We are not responsible for losses caused by unauthorized access due to your failure to secure your account.

4. Marketplace Purpose

Heavy Trader Hub is a listing platform only for:

Heavy equipment and machinery
Construction, agricultural, industrial, and transportation equipment
Parts, attachments, and related commercial services

We do not act as a broker, dealer, agent, escrow service, or inspection provider.

5. Listings and Content

You must have legal authority to list any equipment or items you post.
Listings must be accurate, truthful, and not misleading.
You must disclose known defects, condition issues, and material facts.
Photos must depict the actual equipment or be authorized images.

Prohibited Listings Include:

Illegal, stolen, or restricted equipment
Fraudulent or deceptive listings
Counterfeit or infringing items
Consumer goods unrelated to heavy equipment
Listings posted without authorization from the owner

6. Listing Duration and Removal

Listings are published for ninety (90) days unless renewed.
Heavy Trader Hub may remove, suspend, edit, or deactivate listings at any time, with or without notice, for any reason, including policy violations, suspected fraud, or operational needs.
Listing removal does not entitle users to a refund unless expressly stated.

7. Free, Paid, Renewal, and Featured Listings

The Platform may offer free and paid listing options.
Renewal and featured listing fees, if applicable, are disclosed prior to purchase.
Renewals restart a new 90-day listing period.
Featured listings provide enhanced visibility but do not guarantee inquiries or sales.
All fees are non-refundable unless otherwise stated.

8. Transactions Between Users

Heavy Trader Hub is not a party to transactions between buyers and sellers.
Buyers and sellers are solely responsible for:
- Negotiation and completion of transactions
- Payments, inspections, transport, and delivery
- Compliance with applicable laws and regulations

We do not verify equipment condition, ownership, or legality.

9. Prohibited Use

You may not:

Use the Platform for unlawful purposes
Circumvent fees or platform safeguards
Scrape, harvest, or misuse site data
Interfere with site security or functionality
Post spam, malware, or abusive content

10. Account Suspension or Termination

We may suspend or terminate accounts, with or without notice, if you:

Violate these Terms
Provide false or misleading information
Engage in fraudulent or harmful conduct
Fail to pay applicable fees

Termination may result in listing removal and loss of access without compensation.

11. Intellectual Property

All Platform content, branding, and technology belong to Heavy Trader Hub or its licensors.
Users retain ownership of their content but grant Heavy Trader Hub a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and promote listings.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”
We make no warranties regarding:

Platform availability or uptime
Accuracy of listings
Outcomes of transactions

13. Limitation of Liability

To the fullest extent permitted by law:

Heavy Trader Hub is not liable for indirect, incidental, or consequential damages.
Total liability shall not exceed the amount paid by you to Heavy Trader Hub in the prior twelve (12) months, if any.

14. Indemnification

You agree to indemnify and hold harmless Heavy Trader Hub from claims, losses, damages, or expenses arising from:

Your use of the Platform
Your listings or transactions
Your violation of these Terms or applicable laws

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

16. Changes to Terms

We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
